You can send different commands to the boundary scan interface via JTAG, 
only if boundary scan itself is really used pins are decoupled. The 
Chipscope uses JTAG to, if you would use it, then you would always run 
in trouble, making Chipscope senseless.

Yes, but only if the design wasn't correct. Therefore I would say your 
is not.
